These Terms & Conditions ("Terms") govern your use of the Backglance application ("the App"), a macOS menu bar utility developed and distributed by the Backglance team. By downloading or using the App, you agree to be bound by these Terms.

1. The App

Backglance is a privacy-first desktop utility that uses your device camera to detect movement behind you and displays a subtle visual mirror or alert when movement is detected. The App is designed to help you stay aware of your surroundings in shared workspaces.

Key characteristics of the App:

• All camera processing happens locally on your device.
• Camera frames are never recorded or saved to disk.
• The App does not transmit data over the network.
• No account creation, sign-up, or login is required.
• The App works fully offline.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, and as permitted by the usage rules set forth in the Apple Media Services Terms and Conditions.

3. Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App, except as expressly permitted by applicable law.
• Use the App for any unlawful, harmful, or abusive purpose, including any activity that violates the privacy or rights of others.

4. Intellectual Property

The App, including its original content, features, and functionality, is and will remain the exclusive property of the Backglance team. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

5. Camera & Sensor Access

The App requires access to your device camera to function. You are responsible for granting and managing this permission through macOS System Settings. If you deny camera access, the App's core functionality will not work. The App processes camera input exclusively on your device and does not capture, store, record, or transmit any imagery.

6. Third-Party Services

The App does not integrate with or rely on any third-party analytics, advertising, tracking, or cloud services. No data is shared with any third party because no data leaves your device.

7. Disclaimers

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will always be error-free, uninterrupted, or available at all times.
• Movement detection will be perfectly accurate under all lighting conditions, camera angles, or environmental circumstances.
• The App will prevent all privacy incidents or that it replaces your own awareness of your surroundings.

Backglance is an awareness aid, not a security system. You remain responsible for your own privacy and security.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Backglance team, its contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any conduct or content of any third party on or through the App.
• Unauthorized access, use, or alteration of your device.

Our total liability for any claims under these Terms shall not exceed the amount you paid us to use the App (if any).

9. Updates & Changes

We may update the App from time to time to improve functionality, fix bugs, or address compatibility. We may also modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may also stop using the App at any time by deleting it from your device.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is based, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of that jurisdiction.

12. Apple App Store Provisions

If you obtained the App through Apple's App Store, you acknowledge and agree that:

• These Terms are concluded between you and the Backglance team, not with Apple, Inc.
• Apple has no responsibility for the App or its content.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any).
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
